Learning Registry Terms of Service

The objective of the Learning Registry is to make a large body of Learning Resource metadata, paradata (usage data), analytical data, etc., widely available for use, reuse, distribution, adaptation, etc.   While we encourage the use of open data, and are required to make US federal data open, we recognize that both the learning resources themselves and the metadata and paradata are owned by their creators and may be subject to various usage rights and restrictions in diverse jurisdictions worldwide.  Thus we need to know who owns and has rights to the data that is in the Learning Registry.

As a requirement, all information submitted to the Learning Registry must come from a verifiable, identified source, and all submissions should state the governing rights and conditions for their use.  These submission requirements are fulfilled by including in each submission: (1) the identity of the submitter, (2) a statement of copyright for the submission (used for attribution) and (3) a reference (URL) to a terms of service (ToS) document that describes the conditions placed on the submission, indicating that the submitter agrees to the ToS.  These three data items are maintained through all Learning Registry operations and network data distribution, and are available when data is obtained from the Learning Registry.   The submitter may, without restriction, attach any ToS to their data.  However, any node in the Learning Registry reserves the right, without restriction, to reject any submitted data that does not come from an identifiable submitter or does not have associated rights that are compatible with the goals of the Learning Registry.

Currently, the Learning Registry cannot directly determine what ToS are accepted by any node.  Nodes in the public Learning Registry Network do recognize and accept the different basic ToS listed below.  Any of these may be referenced in a submission.

The ToS recognized by the public Learning Registry support open data; metadata, paradata, etc.  This data can either be in the Public Domain (no known copyright), placed in the Public Domain (copyright waived by owner), or can be copyrighted but licensed under a Creative Commons License.  These ToS allow the nodes in the public Learning Registry network to share data, distribute it to users and support processing needed to provide discovery and access to learning resources.  In addition, all unique data (e.g., new works, not derivative works) generated by the Learning Registry are licensed under the CC-BY-3.0 license.  Note that the Learning Registry, through these ToS and licenses, also waives all sui generis database rights to the collections of data held within the Learning Registry.

The ToS recognized by the public Learning Registry are summarized below.  The URL of the ToS is the unique identifier and is used in the data submissions.  The full ToS (incorporating additional licenses) is found at the listed URL.
